The offer and sale of products through the website https://migus.pt/ are regulated by these Terms and Conditions. Before making a purchase, you must read these conditions carefully. Completion of the purchase implies full knowledge and express acceptance of the Terms and Conditions presented below. Once the online purchase process is complete, you should print and retain these Terms and Conditions for future reference.
These conditions are agreed between the Individual Entrepreneur Jorge Miguel Sousa Lourenço, CPF 245271139, with tax residence at Rua da República 343 5º Esq. Trás, 5370-347 Mirandela, hereinafter referred to as Migus and between any person of legal age (18 years old), individual, non-merchant, who wishes to make a purchase through the website https://migus.pt/, hereinafter referred to as “Customer”.
When making a purchase through the website, the Customer guarantees that he/she is of legal age (18 years old) and has the legal capacity to establish binding contracts.
Making purchases on the website by minors requires express authorization from their parents or legal representative.
These Terms and Conditions are intended to cover the sale of products through the e-commerce functionality available on the website and regulate all the fundamental phases and processes for making the purchase.
These conditions do not govern the provision of services or sale of products by Subjects other than Migus and which may be present on the website through external links or banners.
Products sold on this website can only be purchased and delivered in Portugal.
CUSTOMER REGISTRATION AND PLACING ORDERS
The Customer is solely responsible for the integrity, veracity and complete completion of the user registration form, as well as any orders that may be placed.
The Customer is responsible for always keeping the data relating to their user registration up to date, including the elements relating to their address. The Customer observes, accepts and authorizes that all communications, notifications, statements, information, reports or any documentation regarding the operations carried out, related to the purchase of products on the website, are sent to the email address provided at the time of registration, with the possibility of downloading the information on a durable medium, in accordance with the modalities and limits provided for in the Privacy Policy. Computerized records are stored in computer systems under secure conditions and are proof of communications, orders and payments made between the parties.
APPLICABLE LAWS, DISPUTE RESOLUTION AND JURISDICTION
In accordance with Law No. 144/2015, of September 8, we inform our customers that, in the event of a dispute related to the provision of services or sale of products, they have the possibility of resorting to an Alternative Dispute Resolution (ADR) Entity.
Alternative Dispute Resolution is a simple, fast and cost-effective process that allows consumers to resolve their disputes outside of court.

PRODUCT INFORMATION
Migus will do everything possible to send all the products ordered, but it is possible that, in certain cases and due to causes that are difficult for Migus to control, such as human errors or incidents in computer systems, it will not be possible to make available some of the products ordered by the Customer. If any product is not available after you have placed your order, you will be notified by email. At this point, you will be given the option to cancel the order and receive a refund, if you have already made the payment.
All information regarding prices, products, specifications and promotional actions may be changed at any time by Migus.
RESPONSIBILITIES
All products sold by Migus comply with Portuguese law.
These conditions are governed by Portuguese law and the parties agree to submit to the jurisdiction of the Portuguese courts, or, alternatively, in the event of a dispute arising from a claim for a product purchased exclusively through the website, the Customer may submit their complaint on the Online Dispute Resolution Platform.
COMPLAINTS
The Customer may submit any contractual conflicts to the arbitration and mediation mechanisms that are or may be legally established, as well as complain to Migus about acts and omissions that violate the legal provisions applicable to the acquisition of goods.
The complaint must be submitted within a maximum period of 30 (thirty) days, counting from the date the Client becomes aware of the facts, and will be recorded in Migus’ information systems, which must decide on the complaint and notify the interested party within a maximum period of 30 (thirty) days, counting from the date of receipt.
SHIPPING AND RETURNS
The products are sold to the Customer on the website upon identification by creating a user account and/or filling in the shipping and billing data in accordance with the instructions provided and contextual acceptance of these Terms and Conditions, as well as the prices and description of the products involved in the transaction.
Each sale made on the website may concern one or more products, with no quantity limits for each item (limited to existing stock).
The Customer is prohibited from providing false information during the registration process, during the sale process and in subsequent communications. Migus reserves the right to take legal action against any violation or abuse, in the interest of and to protect all consumers.
Acceptance of these Terms and Conditions implies the exemption of Migus from any liability related to the issuance of incorrect tax documents resulting from errors in the information provided by the Customer during the order process.
The Customer is solely responsible for the correction of this data.
The checkout page on the website includes:
– Description, images, price and quantity of each product;
– Payment methods that can be used (Multibanco Reference, MB Way, Credit/Debit Card and PayPal);
– Delivery methods for purchased products and shipping and delivery costs, where applicable;
– Reference to the store’s Terms and Conditions;
Before completing the order process, the Customer must read and confirm full knowledge and acceptance of these Terms and Conditions.
The order process is complete when we receive the information from the online order form.
Migus reserves the right to cancel orders if it finds that there are no payment guarantees or in situations where the order is placed by a Customer with whom there is an ongoing legal dispute related to a previous order.
This right also applies whenever Migus, with legitimate reasons, considers the Customer to be unsuitable (for example, a Customer with precedents of violating these Terms and Conditions of Sale or implicated in fraudulent activities of any kind).
If, for any reason, an ordered product is not available, Migus undertakes to inform the Customer and refund any amounts paid within a maximum period of 30 (thirty) days from the date of knowledge of such unavailability.
SHIPMENTS AND DELIVERY
Shipping costs to the USA have a maximum value of €8.90 and to the rest of the world have a maximum value of €7.40. This amount varies depending on the type of shipping chosen and the weight of your order. If the customer chooses registered shipping, the tracking code will be sent to the customer’s email.
The order is delivered to the address indicated by the Customer.
Migus is not responsible for any lost or returned orders whose shipping address is incorrect.
Migus is not responsible for any loss or return of orders, if the customer chooses standard shipping.
For this purpose, the system automatically assumes the address that the Customer indicated in his/her account.
However, during the ordering process, the Customer can edit this address or add an alternative address for each specific delivery.
Orders will only be sent after confirmation of stock availability and confirmation of payment, and will be shipped by Migus partner companies, namely CTT.
Information about order delivery will be sent via email to the contacts indicated in the Customer’s account. Migus recommends that these are always updated at the time of ordering.
If the order is unclaimed or delivery is unsuccessful, the order will be returned to Migus.
Migus will reimburse the customer for the amount paid, with the exception of costs incurred in sending the order, as well as any expenses related to storage and new delivery attempts due to the loss caused by the attempt to deliver the order to the customer.
Upon receiving the order, the Customer must check the integrity of the packaging. If any anomalies are detected, these must be recorded accurately and in detail by the shipping company and the delivery refused. Otherwise, the Customer will not be able to complain about this issue.
The average delivery time varies depending on the destination and the chosen delivery method.
Migus always takes steps to ensure delivery within the expected timeframe. If it is not possible to deliver the order within the estimated time, the maximum delivery period will be 90 days.
Migus does not guarantee the deadlines mentioned in the previous points during periods of promotions, sales, Christmas or in the event of stock shortages.
Migus is not responsible for failure to perform any obligation resulting from a force majeure event (event, act or omission beyond its reasonable control).
Orders will be sent following the following rules:
Payments made before 7:00 pm: 1 business day.
Payments made after 7:00 pm: 2 business days.
CANCELLATIONS, EXCHANGES AND RETURNS

The Customer may cancel their order at any time up until it is shipped, with the right to a refund of all amounts paid. Upon receipt of the order by the Customer, the Customer may exercise his/her right to free resolution under the terms legally provided for and indicated below.
Failure to pay for the order within 72 (seventy-two) hours after the date it was placed will result in its automatic cancellation.
Under the terms of Law 7/2004 of 7 January, relating to electronic commerce, Migus reserves the right to unilaterally cancel the order whenever there is a programming error, a malfunction of Migus’ computers or if the contractual proposal arrives at its destination in a deformed manner and the error concerns an essential element of the contract.
ORDER CANCELLATION
As part of its Customer Satisfaction Policy, and under applicable legal terms, Migus allows the exchange or return (termination of the contract) of items, within 30 days from the date of receipt by the Customer, without payment of compensation and without the need to indicate the reason.
Items must be returned within 30 days of receipt.
If you wish to exchange or return items, you can contact Migus, who will provide you with all the information about the exchange/return process. Under no circumstances send items without prior contact as they will not be received.
Returns and exchanges of items must respect the return of items in good condition and with their original packaging complete.
The Customer is responsible for the correct packaging of the products to be returned, as well as the costs inherent in their shipping.
All items will be checked upon arrival at our service and only those that comply with the return conditions will be accepted for exchange or return.
Migus reserves the right not to accept items that do not meet these conditions.
If you have received damaged items or items with technical problems, you must contact Migus to return or exchange the items.
Migus will charge shipping costs to all customers who return items due to customer error.
DISCOUNT CODES
Discount codes are not applicable to sale items.
